The Title Deed (Titre Foncier)

The Moroccan state guarantees that private property is protected and real estate conserved. Real estate is defined as goods (property) one owns personally that can not be moved. It also means the rights over the same goods that can be used and disposed of in any way. It is a guaranteed right, both protected and restricted by law.
Buildings are subject to different laws depending on whether they are recorded or not. Buildings that are not recorded are governed by the traditional regulations and rules of Muslim law. Recorded buildings are subject to modern legislation that, whilst respecting the rules of Muslim law, accord a precise mechanism that confers on it the physical and legal entity of "building".
When real estate is recorded, the recorder produces a 'title deed' containing the following information:
  1. A detailed description of the building (M2, number of rooms, precise location, etc.)

  2. In the case of joint tenancy, the location and description of its different parcels.

  3. The real rights existing on the building.
Effectively the same information and detail that would be expected in a UK title deed.

Where buildings are not recorded, (usually described as having Arabic papers) after the sale has been completed, the new owner can have the property recorded and obtain a modern title deed for a fee of approximately 0.5% of the value of the property.
